👮 Court to decide if deceased teenager's statements can be used in abuse trial
The court is set to rule next Friday on whether testimony from the late Stylianos Constantinou, a 15-year-old who died by suicide in 2019, can be admitted in the trial of 11 suspects over his death. Central to the hearing was whether statements Constantinou made to his former nursery school teacher about alleged abuse at home can be considered evidence. The prosecution argues that such statements qualify under domestic violence laws and the legal principle of "res gestae," which allows immediate reactions after a traumatic event to be accepted as evidence.
Opposing this, the defense cited Supreme Court rulings stating that testimony from a deceased person is not admissible. Constantinou's father faces charges including physical and psychological violence and cruel treatment. The case arose following a government investigation that criticized police and social services for failing to act on signs of abuse before Constantinou's death. Subsequently, his younger siblings were removed from the family home.
