CySEC urges Cyprus investment firms to review proposed EU rules on credit institution reclassification
The Cyprus Securities and Exchange Commission (CySEC) has called on Cyprus investment firms to review new European Banking Authority (EBA) draft rules that could require large firms with assets over €30 billion to become credit institutions. The consultation aims to clarify when investment firms must obtain banking licenses under revised Capital Requirements Directive (CRD) provisions.
The proposed rules specify how to calculate asset thresholds at individual and group levels, reporting obligations, and criteria for waiver assessments by regulators. Only firms exceeding €5 billion in assets would need to report quarterly, with a simplified approach focused on EU-based entities and MiFID-related activities.
CySEC encourages firms to evaluate the impact on their business models and group structures and to participate in the consultation by November 25, 2026. A virtual public hearing will be held on September 30, 2026, to discuss the draft regulatory technical standards ahead of their finalisation.
