Cyprus Court of Appeal Upholds 1977 Limassol Land Expropriation Ruling Ending 50-Year Dispute
The Court of Appeal of Cyprus has unanimously rejected all 16 grounds of appeal in a longstanding land expropriation dispute dating back to 1977. The case concerned the compulsory acquisition of a 2,007-square-metre plot in Limassol for road improvements, a process completed by 1980. The appellants, heirs of the original owner, demanded compensation and various infrastructure provisions, including a new access road.
The court found no evidence of any binding agreement with the Republic that would require additional infrastructure to be built, dismissing claims that a 1993 agreement or a 1992 Land Registry letter obligated the state. It further ruled that issues such as alleged property isolation and lost rental opportunities lacked supporting evidence or were hearsay. The appellants’ request for compensation for loss of use and punitive damages was also dismissed.
This decision upholds the initial ruling and settles the nearly 50-year-old dispute, with the court awarding costs in favor of the Republic of Cyprus. The ruling clarifies that the property owners’ failure to develop or gain direct road access was not attributable to the state.
