Attorney-General Warns Cyprus Prosecutorial Reform May Face Constitutional Challenge
Cyprus Attorney-General George Savvides has raised concerns that the government's proposed reform to separate advisory and prosecutorial powers could be declared unconstitutional once the new public prosecutor begins filing criminal cases. Speaking before parliament's legal affairs committee, Savvides highlighted that four out of seven constitutional experts deemed the amendments unconstitutional, risking the dismantling of the new institutional framework if overturned by the Supreme Constitutional Court.
The reform aims to establish an independent public prosecutor's office alongside the attorney-general, with both appointed by the president for eight-year non-renewable terms. Justice Minister Costas Fitiris acknowledged the constitutional concerns but affirmed the government's commitment to proceed, citing similar systems in the UK, Ireland, and Malta that allow for judicial review.
Savvides expressed particular worry over the bicommunal aspects of the constitution, noting issues arising from the proposed appointment of a deputy public prosecutor from the Turkish Cypriot community. While he insisted his objections were legal rather than personal, other stakeholders, including the Public Service Commission, civil servants' union, and Cyprus Bar Association, emphasized the need for transparency and constitutional safeguards. Parliamentary groups will further examine the proposals before deciding on the next steps.
