Cyprus Supreme Court Rejects Spy's Appeal Over Alleged Illegal Access to Private Communications
The Supreme Court of Cyprus has dismissed an appeal filed by an individual facing espionage charges, ruling that the police did not access private communications illegally prior to obtaining a judicial warrant. The case centers on a warrant issued in June 2025, allowing authorities to access and analyze data from electronic devices seized during an investigation into surveillance of military installations.
The individual was arrested in 2025 after being spotted near British Bases at Episkopi-Akrotiri, Paphos Airport, and the Andreas Papandreou Air Base with cameras and smartphones, suspected of gathering intelligence. Evidence including two mobile phones, three SIM cards, a laptop, and a camera were seized from his residence.
The court found that forensic copying and analysis of the seized devices constituted lawful procedures not amounting to unauthorized access to private communications. Furthermore, the photographic material found on the devices, although extensive, was not considered private communication content. The court also confirmed the investigation complied with proportionality principles. As a result, the Supreme Court upheld the original decision, rejecting the appeal and affirming the legality of the police’s actions.
