Court of Appeal dismisses passenger's negligence claim against Swissport Cyprus after Larnaca airport fall
The Court of Appeal on September 14 upheld a lower court ruling, dismissing a passenger's appeal against Swissport Cyprus Ltd over a fall from aircraft steps at Larnaca airport. The court found no reliable evidence linking Swissport's actions or omissions to the incident, rejecting claims of negligence. Judges maintained the lower court’s assessment that the passenger was not credible while Swissport’s health and safety officer was credible.
The passenger alleged insufficient safety measures, slippery steps, poor lighting, and bad weather contributed to the fall. However, the courts accepted evidence that the steps were equipped with built-in lighting, handrails, anti-slip surfaces, and had been checked prior to use. No fault or hazards were reported, and the court determined Swissport met its duty of care.
The appeal also challenged Swissport's responsibility as aircraft servicer and step operator, but the court agreed with prior findings that no breach of duty occurred. The doctrine of res ipsa loquitur was deemed inapplicable since specific negligence was not established. The passenger was ordered to pay Swissport €2,400 in costs.
