Court of Appeal Increases Prison Sentences for Methamphetamine Possession with Intent to Supply
The Court of Appeal has increased the prison sentences of two individuals convicted of possessing 211 grams of methamphetamine with intent to supply, ruling the original sentences insufficient given the seriousness of the offenses. The first defendant's sentence was raised from four to five and a half years, while the second defendant's sentence increased from three and a half to five years. Both were found guilty of conspiracy and unlawful possession of a controlled drug, with one also charged for overstaying his residence permit.
The Court of Appeal emphasized the need for deterrent sentences in drug-related offenses and highlighted a clear discrepancy between the gravity of the crime and the initial sentences. While acknowledging mitigating factors such as the defendants' admission of guilt and their roles as intermediate links in drug trafficking, the court found these insufficient to justify lower sentences. It underscored that personal circumstances have limited weight in serious drug cases where societal protection and law enforcement take precedence.
The methamphetamine was discovered during a police raid in Nicosia at the residence shared by the defendants. The Court of Appeal’s decision followed an appeal by the attorney general, who argued the original sentencing failed to reflect the offenses' gravity and the need for stronger deterrents.
