Supreme Court reviews blood sample collection from prisoner for genetic material
The Supreme Court of Cyprus has granted permission to file an application seeking to annul a District Court ruling that ordered a prisoner to consent to saliva or blood collection for genetic material extraction. The case questions whether the District Court exceeded its authority in mandating consent for blood sampling.
The original order, issued on July 20, 2026, arose from a police request during investigations into illegal possession and supply of controlled drugs. The Supreme Court highlighted concerns about the necessity and proportionality of drawing blood when saliva, a less invasive source of genetic material, was also available. The police had not sufficiently justified why blood collection was required.
The Court clarified that this case does not challenge the constitutionality of the relevant police law, which was previously upheld. The application will be heard on September 23, 2026, and must be served to the Attorney General at least four days prior. This review aims to ensure legal safeguards are observed regarding genetic data collection from detainees.
