CJEU Rules Against Unrestricted Public Access to Minority Shareholder Data Under EU Law
The Court of Justice of the European Union (CJEU) has ruled that EU company law does not require the disclosure of information concerning all shareholders, especially minority shareholders, and that unrestricted public access to such data violates GDPR principles. This judgement, stemming from Latvian legislation, confirms that personal shareholder information cannot be freely accessible to the general public without conditions like demonstrating a legitimate interest.
The ruling builds on previous CJEU decisions and emphasises the necessity and proportionality criteria under EU data protection laws.
