Supreme Court allows land developer Savvas Kakos to challenge arrest warrant over fraud allegations
The Supreme Court has permitted land developer Savvas Kakos to file an application to quash his arrest warrant issued on July 27. The ruling followed a judge's finding that Kakos presented an arguable case that the warrant may have been issued without meeting necessary conditions. Kakos was arrested amid investigations into 11 fraud-related cases, involving accusations of withdrawn property sale contracts despite payments being made.
Kakos's legal team argued the warrant was unnecessary, disproportionate, and based on concealed material facts. They emphasized that Kakos had prior knowledge of the complaints, and if he intended to interfere with evidence or witnesses, he could have done so earlier. They also pointed out the existence of a search warrant for the location containing evidence, meaning police could secure it without risking destruction or concealment by Kakos.
Supreme Court judge Charis Malachtos noted that there was no indication of fraud but acknowledged that relevant facts may have been withheld from the lower court when the warrant was issued. Kakos was represented by lawyers from Dimitriou & Dimitriou LLP during the proceedings.
