Cyprus law allows partition of co-owned property without unanimous consent to resolve disputes

In Cyprus, co-owners of immovable property who hold undivided shares can seek a partition of the property even if other co-owners disagree, according to Section 29 of the Immovable Property (Tenure, Registration and Valuation) Law, Cap. 224. This law permits the director of the Department of Lands and Surveys to carry out the partition and register separate plots in each co-owner’s name without requiring unanimous consent.

The process begins with demarcating the property boundaries and preparing a survey plan that complies with planning and licensing regulations. The plan is assessed and adjusted before obtaining the necessary permits. Co-owners have the opportunity to propose partition alternatives, and valuation ensures that the distribution reflects each owner’s share fairly. If values differ, monetary compensation can be arranged and secured by law.

In cases where co-owners cannot agree on plot allocation, the final decision is made by drawing lots. The Supreme Court has confirmed that partition applications can proceed without the consent of all co-owners. This legal mechanism aims to prevent indefinite stalemates in co-ownership by allowing property division into clearly defined, usable shares while respecting planning and technical requirements.
